Welcome to FounderSpeak ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our services, website, programs, coaching sessions, content, and related materials (collectively, the "Services").
By purchasing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.
1. DESCRIPTION OF SERVICES
FounderSpeak provides specialized English communication coaching, guidance, mentorship, and professional development support designed for business owners, entrepreneurs, founders, executives, and professionals.
FounderSpeak is not a school, university, language institute, accredited educational institution, or vocational training provider. Our Services are intended to provide coaching and support for professional communication development and are not designed to provide formal education, academic credit, professional licensing, or certification.
2. ELIGIBILITY
You must be at least eighteen (18) years old and legally capable of entering into binding agreements to use our Services.
By using our Services, you represent and warrant that you meet these requirements.
3. NO GUARANTEE OF RESULTS
Individual results vary based on numerous factors, including participation, effort, consistency, prior experience, learning style, and external circumstances.
FounderSpeak does not guarantee:
English fluency;
Specific business outcomes;
Increased revenue or profits;
Employment opportunities;
Promotions;
Immigration benefits;
Professional certifications;
Passing any examination or language assessment.
Any testimonials, examples, or success stories are provided for illustrative purposes only and do not guarantee similar results.
4. CLIENT RESPONSIBILITIES
Clients agree to:
Provide accurate and current information;
Participate actively in sessions;
Complete any recommended exercises or assignments;
Maintain respectful and professional conduct;
Use the Services only for lawful purposes.
FounderSpeak reserves the right to suspend or terminate access to Services for disruptive, abusive, discriminatory, unlawful, or inappropriate behavior.
5. FEES AND PAYMENT
All fees are stated in U.S. Dollars unless otherwise specified.
By purchasing Services, you authorize FounderSpeak to charge the applicable fees using the selected payment method.
Payments are due according to the payment terms provided at the time of purchase.
Failure to make timely payments may result in suspension or termination of Services.
6. REFUND POLICY
Unless otherwise stated in a separate written agreement:
Payments for completed coaching sessions are non-refundable.
Packages, memberships, and prepaid programs may be subject to the refund policy disclosed at the time of purchase.
FounderSpeak reserves the right to evaluate refund requests on a case-by-case basis.
No refunds will be issued for missed sessions, failure to participate, or dissatisfaction resulting from lack of engagement with the program.
7. SCHEDULING AND CANCELLATIONS
Clients are responsible for scheduling sessions according to FounderSpeak's availability.
To reschedule a session, clients must provide at least twenty-four (24) hours' notice.
Sessions canceled with less than twenty-four (24) hours' notice may be considered forfeited and non-refundable.
FounderSpeak reserves the right to reschedule sessions due to unforeseen circumstances.
8. INTELLECTUAL PROPERTY
All content provided through the Services, including but not limited to:
Materials;
Worksheets;
Videos;
Recordings;
Presentations;
Frameworks;
Methodologies;
Branding;
Logos;
Website content;
are owned by FounderSpeak or licensed to FounderSpeak and are protected by applicable intellectual property laws.
Clients receive a limited, non-transferable, non-exclusive license to use such materials for personal business development purposes only.
You may not reproduce, distribute, modify, sell, publish, or exploit any content without prior written permission.
9. CONFIDENTIALITY
FounderSpeak respects the confidentiality of client information.
However, FounderSpeak cannot guarantee absolute security of information transmitted electronically.
Clients agree not to disclose proprietary materials, methods, or confidential information obtained through the Services.
10. RECORDINGS
Coaching sessions may be recorded for quality assurance, training, operational purposes, or to provide clients with access to session replays.
By participating in sessions, you consent to such recordings unless otherwise prohibited by law.
If recordings are provided to clients, they are for personal use only and may not be distributed or shared.
11. DISCLAIMER
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDERSPEAK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
FOUNDERSPEAK MAKES NO GUARANTEES REGARDING THE ACCURACY, COMPLETENESS, OR EFFECTIVENESS OF THE SERVICES.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDERSPEAK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
FOUNDERSPEAK'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY THE CLIENT FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless FounderSpeak, its owners, officers, employees, contractors, and affiliates from any claims, damages, liabilities, losses, costs, or expenses arising from:
Your use of the Services;
Violation of these Terms;
Violation of any law or third-party rights.
14. THIRD-PARTY SERVICES
FounderSpeak may use third-party platforms, including video conferencing, payment processors, scheduling software, and communication tools.
FounderSpeak is not responsible for interruptions, errors, policies, or actions of third-party providers.
15. TERMINATION
FounderSpeak may suspend or terminate access to Services at any time if a client violates these Terms or engages in conduct that negatively impacts the Company, its staff, or other clients.
Upon termination, provisions relating to intellectual property, liability limitations, indemnification, and dispute resolution shall survive.
16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of [STATE], without regard to conflict of law principles.
17. DISPUTE RESOLUTION
Any dispute arising out of or relating to these Terms shall first be addressed through good-faith negotiations.
If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
